FORT MORGAN CONCIERGE
CONCIERGE SERVICE AGREEMENT, LIABILITY WAIVER & THIRD-PARTY VENDOR RELEASE
Thank you for choosing Fort Morgan Concierge to help make your beach vacation relaxing, convenient, and memorable.
Fort Morgan Concierge acts solely as an independent concierge coordination service for optional third-party vendors, products, and experiences. Services may include, but are not limited to, grocery delivery, beach equipment rentals, private chefs, catering, seafood boils, transportation, fishing charters, boat rentals, excursions, photographers, massage services, childcare, event coordination, beach setups, housekeeping, personal shopping, and other requested guest services.
By requesting, purchasing, scheduling, participating in, or accepting concierge services, the Guest agrees to the following terms and conditions:
1. THIRD-PARTY VENDOR RELATIONSHIP
Fort Morgan Concierge is not the provider, owner, operator, employer, insurer, or affiliate of any third-party vendor or service provider. All vendors operate as independent contractors and are solely responsible for their own services, conduct, licensing, insurance, equipment, employees, pricing, scheduling, and performance.
Fort Morgan Concierge operates independently and is not affiliated with, managed by, acting on behalf of, or representing any vacation rental company, property manager, homeowner, lodging provider, or accommodation provider. Concierge services are offered solely as an independent convenience service to guests and customers.
Guest understands that Fort Morgan Concierge merely assists in arranging or coordinating requested services as a convenience and does not supervise, direct, control, inspect, or guarantee the actions, performance, safety, quality, availability, or outcomes of any third-party vendor or service.
2. ASSUMPTION OF RISK
Guest acknowledges that certain concierge-arranged services and activities may involve inherent risks, including but not limited to bodily injury, illness, allergic reactions, accidents, delays, transportation incidents, foodborne illness, water-related dangers, fire hazards, property damage, weather interruptions, or vendor negligence.
Guest voluntarily accepts and assumes all risks associated with participation in any concierge-arranged activity, rental, delivery, or vendor service.
3. RELEASE OF LIABILITY
To the fullest extent permitted by law, Guest agrees to release, waive, discharge, and hold harmless Fort Morgan Concierge, its owners, officers, employees, contractors, representatives, affiliates, agents, and assigns from any and all claims, liabilities, losses, damages, injuries, illnesses, expenses, attorney fees, or causes of action arising out of or related to:
  • Third-party vendor acts, omissions, negligence, misconduct, delays, scheduling conflicts, or cancellations
  • Injury, illness, death, accidents, allergic reactions, or property damage occurring during vendor services or activities
  • Food preparation, grocery substitutions, contamination, or catering-related incidents
  • Water activities, boating, fishing charters, excursions, rentals, or recreational activities
  • Equipment malfunction, misuse, theft, or damages involving rented items
  • Vendor failure to perform, quality of service concerns, dissatisfaction, or unmet expectations
  • Theft, loss, or damage to personal property
Guest agrees that any concerns, disputes, damages, refund requests, or claims regarding services rendered shall be made directly with the applicable vendor.
4. VENDOR LICENSING, INSURANCE & PERFORMANCE DISCLAIMER
Fort Morgan Concierge makes reasonable efforts to work with reputable local providers; however, Fort Morgan Concierge does not independently verify, inspect, supervise, monitor, warrant, or guarantee vendor licensing, qualifications, certifications, permits, insurance coverage, compliance with laws, safety procedures, pricing, availability, or quality of performance.
Selection of any vendor remains at Guest’s sole discretion and risk.
5. PAYMENTS, REFUNDS & CANCELLATIONS
Cancellation policies, refund eligibility, weather policies, rescheduling options, and service terms vary by vendor.
Fort Morgan Concierge is not responsible for vendor cancellations, no-shows, service interruptions, staffing shortages, weather conditions, travel delays, mechanical failures, permit issues, acts of God, emergencies, or circumstances beyond reasonable control.
Any concierge coordination, delivery, administrative, service, or booking fees paid to Fort Morgan Concierge may be non-refundable.
6. PROPERTY ACCESS AUTHORIZATION
Guest authorizes approved third-party vendors to access the rental property, where applicable, during the reservation period for scheduled services.
Guest is responsible for securing valuables, personal belongings, pets, and sensitive items before vendor arrival. Fort Morgan Concierge is not responsible for theft, damages, or losses occurring during vendor access to the property.
7. GOLF CART, BOAT, WATERCRAFT & BEACH EQUIPMENT RENTAL DISCLAIMER
Guest acknowledges that use of golf carts, bicycles, kayaks, paddleboards, boats, jet skis, beach wheelchairs, umbrellas, tents, chairs, grills, games, coolers, and other beach or recreational equipment involves inherent risks, including bodily injury, drowning, collisions, equipment malfunction, weather hazards, and property damage.
Fort Morgan Concierge does not own, inspect, maintain, supervise, operate, or insure any rented equipment provided through third-party vendors and makes no warranties regarding condition, safety, operation, or fitness for use.
Guest assumes all responsibility and liability for the use, supervision, transportation, and operation of rented equipment and agrees to follow all manufacturer recommendations, vendor instructions, safety practices, and local laws.
Guest accepts responsibility for any damage, loss, theft, injury, fines, towing charges, citations, or claims arising from equipment use.
8. FOOD ALLERGY, GROCERY DELIVERY & PRIVATE CHEF DISCLAIMER
Fort Morgan Concierge is not responsible for food preparation, grocery substitutions, ingredient sourcing, seafood handling, labeling accuracy, food contamination, allergens, dietary restrictions, foodborne illness, or food-related injuries associated with grocery delivery, catering, seafood boils, private chefs, meal preparation, restaurants, or food vendors.
Guest is solely responsible for notifying vendors directly regarding allergies, sensitivities, medical conditions, or dietary restrictions.
While reasonable efforts may be made to communicate guest preferences, Fort Morgan Concierge cannot guarantee allergen-free preparation or prevention of cross-contamination.
Guest voluntarily assumes all risks associated with food consumption and releases Fort Morgan Concierge from any related liability.
9. BEACH BONFIRE, OPEN FLAME & OUTDOOR ACTIVITY WAIVER
Guest acknowledges that fire pits, grilling, propane equipment, tiki torches, outdoor cooking, candles, and similar activities/equipment involve inherent risks including burns, smoke inhalation, flying embers, injuries, fire hazards, and property damage.
Guest agrees to comply with all local laws, permits, burn bans, beach regulations, vendor instructions, and safety requirements.
Fort Morgan Concierge does not supervise outdoor activities coordinated through third-party vendors and is not responsible for weather interruptions, injuries, permit violations, property damage, or vendor negligence.
Guest assumes responsibility for supervising minors participating in such activities.
10. ALCOHOL CONSUMPTION DISCLAIMER
Fort Morgan Concierge does not provide, sell, serve, monitor, or supervise alcohol consumption and assumes no liability related to intoxication, impaired driving, injuries, illness, criminal conduct, or damages arising from alcohol consumption by Guest or members of Guest’s party.
Guest agrees to consume alcohol responsibly and arrange safe transportation where appropriate.
11. NO GUARANTEE OF SERVICE OR EXPERIENCE
Fort Morgan Concierge strives to coordinate trusted local services and memorable guest experiences; however, no guarantee is made regarding vendor availability, timeliness, weather conditions, outcomes, quality of service, scheduling, or guest satisfaction.
Availability and service offerings may change without notice due to weather, staffing, emergencies, seasonal demand, mechanical failures, or circumstances outside of reasonable control.
Guest agrees that Fort Morgan Concierge shall not be liable for inconvenience, disappointment, delays, unmet expectations, or dissatisfaction relating to third-party services.
12. INDEMNIFICATION
Guest agrees to indemnify, defend, and hold harmless Fort Morgan Concierge and its owners, employees, representatives, and agents against any claim, liability, damage, loss, expense, or legal action arising from Guest participation in third-party services or Guest’s violation of vendor terms or safety requirements.
13. LIMITATION OF LIABILITY
In no event shall Fort Morgan Concierge be liable for indirect, incidental, consequential, punitive, or special damages.
If liability is found to exist for any reason, Guest agrees that damages shall be limited to the amount of concierge coordination fees actually paid directly to Fort Morgan Concierge.
14. GOVERNING LAW & VENUE
This Agreement shall be governed by and interpreted under the laws of the State of Alabama.
Any disputes arising under this Agreement shall be resolved exclusively in Baldwin County, Alabama.
15. ACKNOWLEDGEMENT & ACCEPTANCE
By purchasing, scheduling, participating in, or accepting concierge services, Guest acknowledges that they have read, understood, and voluntarily agree to these terms and conditions and release of liability.
